The Washington State Department of Labor & Industries (L&I) has recently adopted two workplace rights administrative policies that provide interpretive guidance:

  • ES.A.14 – Employment Relationships provides guidance on employment relationships under the Minimum Wage Act (MWA), including guidance related to independent contractors, joint employment, and successorship.
  • ES.C.2 – Hours Worked provides clarification on L&I’s enforcement positions related to hours worked to reflect changes made to the Minimum Wage Act (MWA) due to Initiative 1433. Other changes include using plain language to provide additional clarity.
